A federal appeals court has reinstated a lawsuit accusing AARP of duping its members into buying overpriced insurance, finding that the seniors’ group may have misled customers about the costs of

the coverage.

In a 2-1 decision, the 11th Circuit Court of Appeals said Monday that AARP can’t claim that it’s entitled to First Amendment protection for its marketing materials because the group has “a

commercial relationship” with UnitedHealthcare, which sells the policies.

The suit was originally filed in 2009 by George McGovern, an AARP member from Florida who accused the group of using its “good name and reputation” to sell   at “unreasonably high prices.”

A lower court had tossed out the case, saying that AARP was protected by the First Amendment because it was engaging in editorial and advocacy work when it endorsed the coverage.

But the appeals court said Monday that AARP can’t have it both ways: It can’t claim First Amendment protections when it suits the organization, but then turn around and say that it’s not engaged in

commercial speech when it comes time to defend itself against allegations of fraud.
